Terms of Use and Membership Agreement

This document explains the rules and responsibilities that apply when you become a member of Polikrami or use the site. We do not want to tell you that you have "agreed" to something you may not have read — which is why we have tried to write this in plain, clear language. 1. Parties

Every visitor who accesses the Polikrami site (whether a member or not), and every artist, student, or hobbyist who holds an account on Polikrami.
2. Scope of Service
Polikrami is an e-commerce platform selling visual art supplies (paint, brushes, canvas, paper, clay, pencils, etc.). It also offers:
- Blog posts and educational content related to the art ecosystem,
- Artist profiles and workshop events,
- Customer reviews and ratings,
as part of its content. This content is provided for informational purposes and is not a substitute for professional art training.
3. Membership Requirements
- Age limit: You must be 18 years of age or older to register. We do not technically prevent those under 18 from opening an account, but we do not allow it; if detected, the account will be closed.
- Accurate information: The details you provide at registration (name, e-mail, phone, address) are expected to be accurate. If inaccurate information is detected, the account may be frozen.
- One account per person: Each person may hold one account. If multiple accounts belonging to the same person are detected, the extras may be closed.
- Password security: You are responsible for not sharing your password with others. Polikrami cannot be held responsible for actions carried out through your account (except where those actions constitute a criminal offence — in which case we will notify the relevant authorities).
4. User Obligations
By using Polikrami, you agree not to do any of the following:
- Use the site for any unlawful purpose.
- Infringe another person's identity, account, or copyright.
- Open an account or place an order using false information.
- Collect bulk data using automated tools (bots, scrapers).
- Attack the site's security or technical infrastructure.
- Submit abusive, offensive, discriminatory, or harmful content (in reviews, artist bios, etc.).
- Send spam, advertisements, or unsolicited commercial messages.
Accounts that breach these obligations may be closed without warning; actions constituting a criminal offence will be reported to the relevant authorities.
5. Polikrami's Obligations
- To operate the site and service with reasonable security measures.
- To protect your personal data in accordance with KVKK and GDPR (see: Privacy Policy).
- To deliver the products you order accurately, undamaged, and on time.
- To respond to your complaints within 7 working days.
- To respond to statutory data requests (KVKK m.11, GDPR DSAR) within 30 days.
Polikrami is bound to fulfil these obligations except in cases of force majeure (natural disaster, courier disruption, regulatory change, etc.).
6. Intellectual Property Rights
6.1 Polikrami's Rights
The design of the Polikrami site, its logo, brand name, software code, product descriptions, photographs (taken by us), and blog posts are the property of Polikrami (Yatgak Bilişim). Copying, reproducing, or using them elsewhere without permission is prohibited under Law No. 5846 on Intellectual and Artistic Works.
6.2 Brand Visuals
Brand logos, images, and technical information used on product pages are used under licence from the respective brands. These belong to the brand owner, not to Polikrami.
6.3 User Content
Content you upload — such as reviews, artist bios, and artwork images — remains your copyright. Polikrami acquires only the right to publish and display it. If you wish to have it removed, you may submit a deletion request and we will remove it.
You confirm that the content you upload does not infringe anyone else's copyright and that you are not sharing others' images or works without permission.
7. Limitation of Liability
We are writing this section honestly — we do not want to disclaim everything, because that would not hold up legally either.
- Polikrami does not guarantee that its service will be uninterrupted or error-free. Scheduled maintenance and technical issues may occur.
- Polikrami is not responsible for the content of third-party sites linked from the site — those links are provided for informational purposes only.
- Polikrami provides general information about the suitability of art materials, but the results of specific use depend on the user's own experience. For example: we may say "this paint is for canvas"; however, canvas quality, brush technique, and environmental conditions all affect the outcome — that assessment is the user's own.
- Statutory liability: your rights under consumer law (return of defective goods, warranty, etc.) are preserved in all circumstances.
8. Termination of Agreement
8.1 By the User
You may close your account at any time. You can initiate the "Delete My Account" process through your member panel, or write to yasal@polikrami.com.
Upon account closure:
- Data for which there is no statutory retention requirement will be deleted within 30 days.
- Order and invoice records will be retained for the statutory period (10 years).
- Your reviews and artist content will be anonymised or deleted according to your preference.
8.2 By Polikrami
Polikrami may suspend or close your account in the following circumstances:
- Material breach of this agreement.
- Unlawful use of the service.
- Suspected fraudulent order or fraud.
Where possible, we will attempt to warn you before closing your account. Closure is not arbitrary, except in urgent cases (where actions constitute a criminal offence).
9. Changes
We may update this agreement in response to changes in legislation or the evolution of our service. When changes are made:
- We will update the "Last updated" date and publish the revised version on this page.
- For significant changes, we will notify you by e-mail or via an on-site notification.
- Continuing to use the site after a change does not constitute agreement to the new terms — you make a conscious decision (as with your membership preferences).
10. Governing Law and Jurisdiction
This agreement is governed by Turkish Law.
In the event of a dispute, the Consumer Arbitration Committees and Courts of the Buyer's place of residence or Polikrami's place of business (Tunceli) shall have jurisdiction. This jurisdiction provision is in the Buyer's favour.
